3. External partners (Payment information)

At Newbie, we use external partners for processing online payments. Your personal data collected by these partners is not shared by Newbie but is provided by you directly to our payment solution partner. It is our payment solution party who is data controller of your payment information. Please contact the chosen payment solution partner directly for more information on how they process your personal data in connection with your payment.

4. Purchases and orders

When you shop on our website, we need to process data about you to manage your order and deliver the ordered products.

4.5 How long is the personal data retained?

The personal data is retained until the expiry of the statutory or possible contractual warranty and guarantee rights in order to complete the delivery of your order and handle any returns. In addition, we are obliged by commercial and tax law to store your address, payment and order data for a period of 10 years. However, after 3 years we will restrict the processing, which means that from this point on your data will only be used to comply with the legal obligations.

Personal data is retained for up to 12 months from your last activity or until you withdraw your consent. By activity, we mean if you purchase an item, open or click on a link in a sent email, or log in to your account.

7. Marketing

We market our products, services, and company to you in various ways. In this section, we describe how we process your data when we market to you.

7.1 Direct marketing

We send direct marketing to you using various types of contact information, such as address, or email address.

When we use advertising platforms, it means we collect and transfer your data to these platforms. We also select the target audience that will receive our marketing content.

The content of our direct marketing can vary. For example, we may send direct marketing based on products and services you have shown interest in, such as if you have added products to the cart in our e-commerce but have not completed your purchase, to provide you with offers from our partners or send invitations to competitions and events. To understand what type of content we should use in our direct marketing, we analyze all or parts of the personal data we collect according to section 7.1.1 above.

In addition to our direct marketing, we can also use target groups and other selections in various advertising tools. We process your personal data to display ads to you based on your online identifiers that have been collected and registered upon your visits to our various digital channels. This means we collect and transfer your data to advertising platforms, such as social media, search engines, or ad networks so that they can match or include you in a relevant target audience. We also select the target audience that will receive our ad content.

The content of the ads you see may vary as we strive to provide you with relevant information. The content is therefore based on various factors, such as how you use our digital channels and which products and web pages you click on, your purchase history, and other personal data we collect for this purpose. This means that our customers do not always see the same ad content.

We also use our target audiences, which may include personal data, to allow our marketing partner to find people with similar interests who might also like our products and services.

9. Competitions and events

We may send invitations to you to participate in competitions and events. To be able to do this, including sending prizes and communicating with you, we will process data about you.

9.2 What is the personal data used for?

Your personal data is used to register your entry and communicate with you if needed for the execution of the competition or event. In connection with an event, we may also send confirmation of your registration, information about the event that you need to know, and other similar matters.

Regarding competitions, we check and/or select winners and distribute prizes related to the competition. When we conduct competitions on social media, we will process data about you to contact you if you have won the competition. We will then use the channels available on the respective platform, such as Instagram DM, or Facebook Messenger. The personal data is handled according to the applicable policy for each platform.

9.3 What is the legal basis for our processing?

We process your personal data based on our legitimate interest in conducting, administering, and evaluating our competitions and events.

9.4 Who is the personal data shared with?

We share your personal data with our chosen event or competition partner, our suppliers of our CRM system, email system, and the chosen competition channel (e.g., social media).

9.5 How long is the personal data retained?

Your personal data collected during competitions is retained for up to 12 months from the expiry of the year of the competition’s end date.

Note that the competition entries you submit may be retained for an indefinite period according to applicable competition terms. If a competition has been conducted on social media, your personal data will be retained until you choose to delete your entry or until you delete your account.

10. Providing services in our digital channels

We process your personal data so that you can use our digital services (e.g., our website), and so that we can offer a fast, responsive, and secure website as well as deliver specific features that you request.

11.2 What is the personal data used for?

Your personal data is used to enable various types of analyses, reports, and decision-making materials. To the extent possible, such analyses are conducted in an aggregated format, which means that our reports only provide information about, for example, how all our customers or customer groups have shopped over a period, without specifically indicating how you, individually, have shopped.

We use your information to make services more user-friendly, for example, by changing the user interface to simplify the flow of information or to highlight features that are often used by our customers in digital channels.

Your information is also used to send surveys or similar evaluations to customers regarding (i) customers' purchase and/or delivery experience, (ii) contacts with customer service, and (iii) competitions and events. This includes compiling and analyzing customers' feedback and usage and making decisions on improvement measures.

We also follow up on results and sales statistics related to one or more mailings to develop and optimize our direct marketing.

We analyze and evaluate (i) advertising campaigns, (ii) customer personalization on the website, (iii) customer service, and (iv) use of the company's digital channels. This includes making decisions on changes to develop and optimize the mentioned points.

We also use your information to create materials to develop and optimize (i) goods and logistics flows, for example, by being able to forecast purchases, inventory, and deliveries, (ii) our assortment, (iii) our resource efficiency from an environmental and sustainability perspective, for example, by streamlining purchases and planning deliveries, (iv) planning new store and warehouse establishments, and (v) the security of our IT systems.

11.3 What is the legal basis for our processing?

We process personal data based on our legitimate interest in being able to develop and improve our business, products, and services.

11.4 Who is the personal data shared with?

We share personal data with our suppliers of our analytics systems, BI platform (Business Intelligence), CRM system, e-commerce platform, ERP system (Enterprise Resource Planning), customer surveys (both companies that conduct surveys and companies that provide the system for customer surveys), customer review tool, order management system, POS system (Point of sales/cash register systems), and case management system.

11.5 How long is the personal data retained?

We retain the data for the time necessary for the purpose of the analysis or evaluation. This can vary between different types of analyses, and we therefore find it difficult to specify a specific retention period in advance. However, we have implemented routines to ensure that personal data that we have not used for a period of up to 5 years is deleted or anonymized, as we then consider that your personal data is no longer necessary.

12. Security work, and to disclose or investigate abuse of our services, crimes and accidents

To disclose or investigate abuse of any of the services that Newbie offers or to disclose, or investigate crimes or accidents related to Newbie, we process data about you.

For example, we have various security systems used to be able to investigate spam, phishing, harassment, attempts at unauthorized login to user accounts, or other actions prohibited by relevant terms and conditions.

We also have systems that use your information to protect and improve our IT environment against cyber-attacks and intrusions.

12.3 What is the legal basis for our processing?

We process personal data based on our legitimate interest in being able to conduct systematic security work and to disclose or investigate abuse of our services, crimes, or accidents.

12.4 Who is the personal data shared with?

We share personal data with our suppliers of our e-commerce platform, information security systems, camera surveillance system, and order management system.

12.5 How long is the personal data retained?

The personal data is retained for up to 36 months after collection. If we suspect abuse of a service or that a crime has been committed, we will retain the data for the time necessary to establish, assert, or defend our (or third parties') legal claims.

13. Legal obligations

In some cases, Newbie processes your personal data according to requirements in laws, judgments, or government decisions. We do this to fulfill requirements according to legal obligations.

13.2 What is the personal data used for?

Your data is used to meet requirements regarding product liability and product safety, such as creating communication and information for the public and customers about product alerts and product recalls, for example, in the case of an unsafe product. By using cookies, we also follow up on opening statistics in emails when sending product recalls to ensure that we meet information requirements about product recalls.

In addition, we document transactions and agreements according to the Accounting Act and document and investigate transactions according to applicable Anti-Money Laundering legislation.

13.3 What is the legal basis for our processing?

We process your information based on legal obligations according to applicable law, such as legal requirements related to product safety legislation, the Accounting Act, and Anti-Money Laundering legislation.

Information related to your purchase and transactions must be provided for us to enable your order. Contact information allows us to contact you in the event of a product recall. These details are not mandatory but may affect how you receive information about unsafe products we have sold to you.

13.4 Who is the personal data shared with?

We share personal data with our suppliers of our chat tool, CRM system, e-commerce platform, email system, ERP system (Enterprise Resource Planning), order management system, and case management system.

13.5 How long is the personal data retained?

The personal data is retained for the time necessary to fulfill the relevant legal obligation or in accordance with applicable legal requirements. For example, according to the Accounting Act, we must retain certain information about your purchase for 7 years.

14. Legal claims

We strive to always be able to resolve any issues you have as a customer. In cases where we cannot find a solution, we may need to process your personal data to process any relevant legal claims. There may also be legal claims in other processes that require us to share personal data with counterparties, for example, in various types of transactions.

14.2 What is the personal data used for?

We use your personal data to process and respond to claims relevant to the dispute. In addition to the personal data mentioned above, we may also use other data collected during previous contacts with us. See the respective section for more information about such data.

We share your personal data with potential buyers of our business in connection with a due diligence process prior to a business transaction.

14.3 What is the legal basis for our processing?

We process your information based on our, or a third party’s, legitimate interest in being able to handle and respond to legal claims, or to enable the sale and acquisition of our company.

Any processing of data about legal violations is only performed if this is necessary to establish, assert, or defend legal claims in individual cases.

14.4 Who is the personal data shared with?

We share personal data with our chosen external advisors, and/or authorities, courts, counterparties, as well as potential buyers and sellers.

14.5 How long is the personal data retained?

The personal data is retained for the time necessary to fulfill the relevant legal requirement and at most 24 months from the end of the year that the relevant case was finally closed/settled to complete any internal or third-party audit.

14.6 Cookies

We do not use cookies for this purpose.

15. Transfers to countries outside the EU/EES

In cases where information is transferred or made available in countries not covered by the GDPR, we must ensure that the receiving parties process the information as securely as if it had remained within the EU/EEA. Newbie always ensures that a valid transfer mechanism is in place before the transfer begins.

For transfers to recipients in the USA, we base the transfer on the EU-U.S. Data Privacy Framework, and for other countries outside the EU/EEA, we apply the EU Commission's standard contractual clauses.

We transfer personal data to third countries in connection with our use of the following categories of recipients:

  • Advertising platforms: USA, Chile, Singapore, and Taiwan.

  • Suppliers of e-commerce platforms: New Zealand and USA.

  • Suppliers of analytics systems: USA, Chile, Singapore, Taiwan.

  • Suppliers of customer service systems: USA.

  • Logistics partners: If the delivery takes place outside the EU/EEA, the personal data will also be shared with the carrier in the relevant country.

16. Your rights

If you want to exercise your rights or have other questions regarding how we process your personal data, you are welcome to contact us via our customer care. We take our role as data controller very seriously, and it is important that you, as a customer, feel secure with how your data is processed.

16.1 Right of access, right to rectification and right to erasure

You have the right to access information about the personal data we process, and you also have the right to request rectification if any data is incorrect. Under certain circumstances, you can have your personal data deleted or request a restriction of processing. For example, if you have not given consent or have withdrawn your consent.

Certain data covered by legal requirements and regulations, such as accounting, will not be deleted and data needed as evidence in any ongoing cases will not be deleted until these cases are concluded, and the data is no longer needed.

16.2 Right to withdraw your consent

If you have given your consent for us to process your personal data and it is the only legal basis we have to process the data, you have the right to withdraw this consent at any time. In such case, we will no longer continue to collect your personal data based on your consent. Note, however, that we will still process personal data that you have already provided to us before the consent is withdrawn. This is done in accordance with applicable retention periods for the relevant purpose.

Contact us via customer care if you need help withdrawing your consent. Consents you have given via our consent manager on our website can be withdrawn by yourself through our consent manager. You can find it by clicking on the "Cookies" link at the bottom left of each webpage.

16.3 Right to restriction of our processing

In certain cases, you have the right to request that the processing of your personal data be restricted. Restriction means that the data is marked so that it can only be processed for certain limited purposes in the future.

The right to restriction applies, among other things, when you believe that the data is incorrect and have requested rectification. In such cases, you can request that the processing of the data be restricted while the accuracy of the data is being investigated.

16.4 Right to object to processing of personal data based on our legitimate interest

You can also object to the processing of your personal data if the processing is based on our legitimate interest, i.e., a balance between the benefit of the processing and the risk to individuals' personal integrity. To continue processing your personal data after such an objection, we need to be able to show that we have compelling legitimate grounds that outweigh your interests, rights, or freedoms.

If you do not want us to process your personal data for direct marketing purposes, you can notify us. The easiest way to do this is via your user account, or on our website.

16.5 Right to data portability

You have the right to receive a copy of the personal data you have provided to us in a structured format. The right to data portability, unlike the right to access, thus only covers data that you have provided to us and that we process based on certain legal grounds, such as an agreement with you or your prior consent.

16.6 Right to file a complaint with the supervisory authority

If you are not satisfied with our processing of your personal data and/or the responses you have received from us, you have the right to lodge a complaint with your national supervisory authority regarding the processing of your personal data.
